A man arrested by police patrol and convicted by a criminal court for possessing unsilenced firearms and ammunition has now been sentenced one year in jail by The Court of Appeal.
He was first convicted to three years imprisonment and a fine of QR10,000 by The Court of Appeal. The accused then appealed the verdict and the Court of Appeal listened to his argument and accepted the appeal. Citing Article 93 of the Qatari Penal Code, the court decided to reduce the verdict to one year suspended imprisonment without the fine. The court believed that the accused would not repeat such an offence in the future.
Qatari Penal Code, Article 93 says that should the court consider, when sentencing for a misdemeanour that the circumstances of the offence or the perpetrator require mercy, it may reduce the penalty if there is a minimum limit for the penalty, the court may not comply therewith. It can also be reduced if the penalty is imprisonment and a fine together, the court shall impose one of them only. The Article also says that if the penalty is imprisonment without a minimum term limit, the court may apply a fine not exceeding QR5,000.
